General warranty conditions

1. Hypersens Sp. z o. o. based in Toruń, hereinafter referred to as the Manufacturer, ensures that the devices manufactured by it meet the currently applicable quality and safety standards and are compliant with current legal regulations.
2. The manufacturer provides a warranty for the device and its components installed in the device and listed in the documentation.
3. The manufacturer guarantees the quality of the device for a period of 12 months from the date of sale.
4. Defects discovered during use of the device will be removed at the expense of the Manufacturer.
5. The warranty does not cover maintenance and inspections of the device related to its use.
6. Gwarancja nie obejmuje urządzeń z uszkodzeniami mechanicznymi lub elektrycznymi powstałych bez udziału Producenta, w szczególności:
   1. uszkodzeń powstałych w trakcie transportu,
   2. uszkodzeń powstałych w wyniku niewłaściwego montażu i uruchomienia urządzenia przez nabywcę,
   3. uszkodzeń powstałych w wyniku niewłaściwego użytkowania urządzenia, używania urządzenia niezgodnie z instrukcją obsługi względnie niezgodnie z zasadami bezpieczeństwa,
   4. uszkodzeń powstałych w niestabilnej pracy sieci energetycznej,
   5. uszkodzeń powstałych w wyniku użytkowania urządzenia (dotyczy sond hydrostatycznych oraz przetworników ciśnienia) w warunkach na które produkt nie jest odporny. [opis materiałów poszczególnych produktów znajduje się w DTR],
   6. uszkodzeń będących wynikiem zdarzeń losowych, min tj:
      1. pożar
      2. uderzenie pioruna
      3. wybuch
7. The warranty does not cover devices in which alterations, modifications, changes or repairs have been made by persons other than the Manufacturer.
8. The warranty does not cover claims regarding the technical parameters of the device if they are consistent with the parameters specified in the device documentation.
9. The manufacturer is not liable under this warranty if it is impossible to perform the repair due to the introduction of new legal standards or unforeseen circumstances that prevent it from being carried out.
10. The manufacturer is not liable under this agreement in the event of import/export restrictions imposed on spare parts of the device.
11. The rights arising from this warranty may be exercised by the purchaser who, at the time of requesting the warranty service:
    1. Przedstawi dokument gwarancyjny (dowód zakupu),
    2. Przekaże wadliwie działające urządzenie.
12. Warranty repairs are carried out at the manufacturer's headquarters.
13. The purchaser of the device is obliged to send the defective device to the place of repair, together with an indication of any defects in its operation or damage resulting from proper use. The cost of shipping the device within the Republic of Poland is borne by the Manufacturer.
14. Any damage resulting from transporting the defective device to the Manufacturer's headquarters is not covered by the warranty and is the responsibility of the Purchaser. The manufacturer is not responsible for the loss of the device during transport.
15. A defective device sent to the Manufacturer for warranty repair must meet basic hygiene conditions. All activities undertaken by the Manufacturer and related to cleaning the device will be carried out for a fee, the payment of which will determine the warranty repair.
16. The warranty repair will be carried out within a period no longer than 21 days from the date of receipt of the defective device by the Manufacturer. This deadline may be extended, but this requires prior arrangement with the Buyer.
17. Wymiana urządzenia na nowe możliwe będzie w przypadku:
    1. Dwukrotnego zgłoszenia wady urządzenia przez Nabywcę,
    2. Wycofania modelu z produkcji (w tym przypadku Producent wymieni urządzenie na inne o parametrach zbliżonych do urządzenia wymienianego).
18. The replaced device or its components subject to replacement under warranty service become the property of the Manufacturer.
19. The Buyer's rights under the warranty do not include claims for compensation for benefits lost due to device failure.
20. The manufacturer is not liable for any health damage resulting from improper installation or use of the device.
21. In matters not regulated in this document, the relevant provisions of the Civil Code shall apply.
